Terms of Service

1. Acceptance of Terms

Welcome to Re-Live. By downloading, installing, or using the Re-Live mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Re-Live (“we,” “our,” or “us”). We may modify these Terms at any time, and your continued use of the App after such modifications constitutes acceptance of the updated Terms.

2. Description of Service

Re-Live is a mobile application that uses artificial intelligence to animate still photographs, creating short video clips that bring your photos to life. Our service allows you to:

• Upload photographs from your device
• Optionally provide text descriptions (“memory prompts”) to guide the animation
• Generate animated videos from your photographs
• Save generated videos to your device or share them
• Manage your generation history and favorites

3. Account Registration

To use Re-Live, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and current
• Maintain the security and confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years of age to create an account and use Re-Live. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

4. User Content

Your Ownership

You retain all ownership rights to the photographs you upload to Re-Live (“User Content”). We do not claim ownership of your photos or the generated videos derived from them.

License Grant

By uploading photos to Re-Live, you grant us a limited, non-exclusive, royalty-free license to:

• Process your photos using our AI technology to generate animated videos
• Store your photos and generated videos on our servers to provide the service
• Display your content back to you within the App

This license terminates when you delete your content or your account.

Your Responsibilities

You represent and warrant that:

• You own the photos you upload or have obtained all necessary rights and permissions
• You have consent from any individuals depicted in the photos (or their legal guardians)
• Your User Content does not violate any third-party rights or applicable laws
• Your use of Re-Live complies with all applicable laws and regulations

5. Acceptable Use Policy

You agree not to use Re-Live to:

• Upload content you do not have the right to use
• Create content that is defamatory, harassing, threatening, or discriminatory
• Generate deepfakes or misleading content intended to deceive others
• Create content depicting minors in any inappropriate context
• Upload sexually explicit or pornographic material
• Create content that promotes violence, terrorism, or illegal activities
• Impersonate another person without their consent
• Attempt to reverse engineer, decompile, or hack the App
• Use automated systems or bots to access the service
• Circumvent any technical measures we use to provide the service

We reserve the right to remove content and suspend or terminate accounts that violate these terms.

6. Subscriptions and Payments

Free Trial

Re-Live offers a free trial that includes a limited number of video generations. Free trial generations include a Re-Live watermark on the output video.

Premium Subscription

Premium subscriptions provide unlimited generations without watermarks and additional features. Subscriptions are billed through Apple's App Store. By subscribing, you agree to:

• Pay the subscription fee displayed at the time of purchase
• Automatic renewal at the end of each billing period unless cancelled
• Apple's payment terms and conditions

Cancellation

You may cancel your subscription at any time through your Apple App Store account settings. Cancellation will take effect at the end of the current billing period. No refunds are provided for partial subscription periods.

Price Changes

We reserve the right to change subscription prices. You will be notified of any price changes before they take effect, and your continued use of the premium features after the price change constitutes acceptance of the new pricing.

7. Intellectual Property

Re-Live and its original content (excluding User Content), features, and functionality are owned by Re-Live and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Re-Live name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks. You may not use these marks without our prior written permission.

8. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• The quality of any products, services, or information obtained through the App will meet your expectations
• Any errors in the App will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RE-LIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Re-Live and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with: (a) your access to or use of the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

11. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will cease immediately. If you wish to terminate your account, you may do so by deleting your account in the App settings. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Re-Live regarding the App and supersede all prior agreements.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
